(c) ` Range State` means any State (whether or not it is a Party to the Convention) that exercises jurisdiction over any part of the range of a species covered by this Agreement;

recognizing the need for conservation measures to protect all populations of Chiroptera species in Europe and in their non-European Range States;

` (b) ` Bats` means populations of CHIROPTERA species as listed in Annex 1 to this Agreement occurring in Europe and in their non-European Range States` ;

convinced that any taking of migratory waterbirds must be conducted on a sustainable basis, taking into account the conservation status of the species concerned over their entire range as well as their biological characteristics;

(c) ` Waterbirds` means those species of birds that are ecologically dependent on wetlands for at least part of their annual cycle, have a range which lies entirely or partly within the Agreement Area and are listed in Annex 2 to this Agreement;

Conscious that the threats facing bats in Europe and non-European Range States are common to both migratory and non-migratory species and that roosts are often shared by migratory and non-migratory species;

(a) designate the Authority or Authorities to implement this Agreement which shall, inter alia, monitor all activities that may have impact on the conservation status of those migratory waterbird species of which the Party is a Range State;

However, a Range State or Regional Economic Integration Organisation may, on becoming a Party in accordance with Article X or XI, enter a specific reservation with regard to any particular species of bat.

Recognising the unfavourable conservation status of bats in Europe and non-European Range States and in particular the serious threat to them from habitat degradation, disturbance of roosting sites and certain pesticides;

(d) coordinate their efforts to ensure that a network of suitable habitats is maintained or, where appropriate, re-established throughout the entire range of each migratory waterbird species concerned, in particular where wetlands extend over the area of more than one Party to this Agreement;

acknowledging that effective implementation of such an Agreement will require assistance to be provided to some Range States for research, training and monitoring of migratory waterbird species and their habitats, for the management of those habitats as well as for the establishment or improvement of scientific and administrative institutions for the implementation of this Agreement,

the natural range of the species is neither being reduced nor is likely to be reduced for the foreseeable future, and

For genetic reasons, the seed should be collected at places of origin within the natural range of the relevant species and the strictest possible guarantees should be given to ensure the identity of the seed.

Range States

describe the range and migration route of the migratory species;

Parties that are Range States of a migratory species listed in Appendix I shall endeavour:

to maintain and publish a list of Range States of all migratory species included in Appendices I and II;

the range of the migratory species is neither currently being reduced, nor is likely to be reduced, on a long-term basis;

Each Agreement should cover the whole of the range of the migratory species concerned and should be open to accession by all Range States of that species, whether or not they are Parties to this Convention.

'habitat' means any area in the range of a migratory species which contains suitable living conditions for that species;

'endangered' in relation to a particular migratory species means that the migratory species is in danger of extinction throughout all or a significant portion of its range;

Parties that are Range States of a migratory species listed in Appendix I shall prohibit the taking of animals belonging to such species.

The Parties shall keep the Secretariat informed as to which of the migratory species listed in Appendices I and II they consider they are Range States;

A list of the Range States of migratory species listed in Appendices I and II shall be kept up to date by the Secretariat using information it has received from the Parties.

Whereas the said list has been established on the basis of information requested by the Commission from countries within the known distribution area of the species referred to in Annex I to Regulation (EEC) No 3254/91;

making recommendations to the Conference of the Parties as to the migratory species to be included in Appendices I or II, together with an indication of the range of such migratory species;

'range' means all the areas of land or water that a migratory species inhabits, stays in temporarily, crosses or overflies at any time on its normal migration route;

The Conference of the Parties may recommend to the Parties that are Range States of a migratory species listed in Appendix I that they take further measures considered appropriate to benefit the species.

Whereas, for genetic reasons, the reproductive material must be collected at places of origin within the natural range of the relevant species and the strictest possible guarantees should be given to ensure the identity of the material;

in those cases where an Agreement has not been concluded, make recommendations for the convening of meetings of the Parties that are Range States of a migratory species or group of migratory species to discuss measures to improve the conservation status of the species;

Parties that are Range States of migratory species listed in Appendix II shall endeavour to conclude Agreements where these would benefit the species and should give priority to those species in an unfavourable conservation status.

'Range State' in relation to a particular migratory species means any State (and where appropriate any other party referred to under subparagraph (k) of this paragraph) that exercises jurisdiction over any part of the range of that migratory species, or a State, flag vessels of which are engaged outside national jurisdictional limits in taking that migratory species;

Only in that way is it possible to realise the objective, in the first subparagraph of Article 3(1) of Directive 92/43/EEC, of maintaining or restoring the natural habitat types and the species' habitats concerned at a favourable conservation status in their natural range, which may lie across one or more frontiers inside the Community."

at a minimum, prohibit, in relation to a migratory species of the Order Cetacea, any taking that is not permitted for that migratory species under any other multilateral agreement and provide for accession to the Agreement by States that are not Range States of that migratory species.

The Parties which are Range States for migratory species listed in Appendix I or Appendix II should inform the Conference of the Parties through the Secretariat, at least six months prior to each ordinary meeting of the Conference, on measures that they are taking to implement the provisions of this Convention for these species.

The Parties acknowledge the importance of migratory species being conserved and of Range States agreeing to take action to this end whenever possible and appropriate, paying special attention to migratory species the conservation status of which is unfavourable, and taking individually or in cooperation appropriate and necessary steps to conserve such species and' their habitat.

the natural range of the species is neither being reduced nor is likely to be reduced for the foreseeable future, and

Degree of isolation of the population present on the site in relation to the natural range of the species.

"Endemic species" means any species whose range is restricted to a limited geographical area;

"Endangered species" means any species that is in danger of extinction throughout all or part of its range;

MEMBER STATES SHALL ENSURE THAT THE HUNTING OF THESE SPECIES DOES NOT JEOPARDIZE CONSERVATION EFFORTS IN THEIR DISTRIBUTION AREA.

For animal species ranging over wide areas these sites shall correspond to the places within the natural range of such species which present the physical or biological factors essential to their life and reproduction.

For animal species ranging over wide areas, sites of Community importance shall correspond to the places within the natural range of such species which present the physical or biological factors essential to their life and reproduction;

"habitat" means any area in the range of a migratory species which contains suitable living conditions for that species;

"endangered" in relation to a particular migratory species means that the migratory species is in danger of extinction throughout all or a significant portion of its range;

endangered, except those species whose natural range is marginal in that territory and which are not endangered or vulnerable in the western palearctic region;

priority species means species referred to in (g) (i) for the conservation of which the Community has particular responsibility in view of the proportion of their natural range which falls within the territory referred to in Article 2;

THE SPECIES MENTIONED IN ANNEX I SHALL BE THE SUBJECT OF SPECIAL CONSERVATION MEASURES CONCERNING THEIR HABITAT IN ORDER TO ENSURE THEIR SURVIVAL AND REPRODUCTION IN THEIR AREA OF DISTRIBUTION.

Member States shall take the requisite measures to establish a system of strict protection for the animal species listed in Annex IV (a) in their natural range, prohibiting:

WHEREAS CERTAIN SPECIES OF BIRDS SHOULD BE THE SUBJECT OF SPECIAL CONSERVATION MEASURES CONCERNING THEIR HABITATS IN ORDER TO ENSURE THEIR SURVIVAL AND REPRODUCTION IN THEIR AREA OF DISTRIBUTION;
