(2) Naročnik mora sprejeti predpis iz 126. člena tega zakona najkasneje v dveh mesecih od dneva uveljavitve tega zakona. Dokler naročnik ne sprejme predpisa iz 126. člena tega zakona, mora oddajati naročila malih vrednosti skladno z določili tega zakona, ne glede na ocenjeno vrednost. Ministrstva, lokalne skupnosti in drugi naročniki, ki pokrivajo druge manjše naročnike, lahko pripravijo za te naročnike enotni predpis za oddajo naročila male vrednosti. Proračunski inšpektor, nadzorni svet občine, nadzorni svet javnega podjetja, javnega sklada ali javnega zavoda lahko naloži naročniku, ki ga nadzoruje, da, ne glede na določbo 126. člena tega zakona, odda javno naročilo v skladu s tem zakonom, če oceni, da se z oddajanjem javnih naročil male vrednosti ne dosega gospodarno ravnanje z javnimi sredstvi.
(2) Contractors shall adopt the regulation stated in Article 126 within two months following the enforcement of this Act. Until then, contractors shall award low-value contracts in accordance with the provisions of this Act regardless of the estimated value. Ministries, local communities and other contractors controlling other minor contractors may prepare a uniform regulation for these minor contractors for the award of low-value contracts. The budget inspector, the municipal supervisory council, the supervisory council of a public utility, a public fund or a public institution may ask that the controlled contractor awards a contract without prejudice to Article 126 above, if they consider that the award of low-value contracts can not achieve economy in handling public assets.

V primerih iz (b) se prag nanaša na celotni znesek nagrad in plačil, vključno z ocenjeno vrednostjo javnih naročil storitev brez DDV, ki se lahko pozneje oddajo po členu 31(3), če naročnik v javnem razpisu za natečaj ne izključi take oddaje.
In the cases referred to in (b), the threshold refers to the total amount of the prizes and payments, including the estimated value net of VAT of the public services contract which might subsequently be concluded under Article 31(3) if the contracting authority does not exclude such an award in the contest notice.
