Decision of the court

The decision of the Court of Justice of the European Communities shall be conclusive and shall be accepted as such by the parties without restriction or reservation.

The decision of the court of second instance on the lack of subject matter jurisdiction of the court of first instance shall be bind every court to which the case may subsequently be transferred, provided that upon issuance of such decision the court of second instance had power to decide upon the jurisdictional dispute between both courts concerned.

The decision of the Court of Justice on the appeal

The decision of the Tribunal is final and shall be complied with by all the parties to the dispute.

Disposition of the Court of Second Instance on Appeal

However, interveners other than the Member States and the institutions of the Union may bring such an appeal only where the decision of the General Court directly affects them.

In decision rendered in civil proceedings shall take form either of a judgment or of a decree.

to decide upon appeals against the decisions of high courts;

Enforcement may be suspended only by a decision of the Court of Justice of the European Union.

An administrative dispute shall be allowed against a ruling by the disciplinary tribunal.

No special appeal shall lie against the decree passed in pursuance of the first paragraph of the present Article.

No special appeal shall be allowed against the decision by which the court has permitted an intervention.

If the Court rejects the appeal, the decision of the Arbitration Committee shall become final.

Until the expiration of the time period prescribed for submitting of the power of attorney, the court may not pass any decision;

In deciding upon appeals against decisions of high courts, the Supreme Court shall sit in a panel consisting of three judges.

To establish the disputed facts which are of importance to determination of the dispute, the court may also examine the parties.

The motion to reopen the proceedings shall always be filed with court which has rendered the judgment in first instance.

The person detained has the right to appeal against the court order, and such appeal must be decided by a court within forty-eight hours.

Article 166 (1) The court in the first instance must perform all procedural acts and discuss all disputed questions to which the higher court has drawn attention in its decision.

(3) The decision on a complaint against a decision of first instance in an administrative dispute shall be made by the Supreme Court.

The proposal must be made within one month of delivery of the decision by the General Court.

A copy of the decision of the revising court shall also be sent to the State Prosecutor of the Republic of Slovenia.

(2) The Supreme Court shall adjudicate on appeals against decisions passed by the Administrative Court panel with a pane) of five judges, and on appeals against other Administrative Court rulings with a panel of three judges.

If the same decision is attacked both by the revision and the petition for protection of legality, the Supreme Court shall determine all controversies by a single judgment.

Prior to passing of a decision ordering a third person to produce a document, the court shall invite them make a statement thereon.

(6) Entry in the ownership and burden documents shall be done by the Administration on the basis of a final decision of a court of jurisdiction.

The property and assets of the Bank shall not be liable to attachment or to seizure by way of execution except by decision of a court.

if the court has determined a claim which falls under the subject matter jurisdiction of a high court of the same type or of a court of different type, or if upon a plea of a party it has incorrectly decided to assume the territorial jurisdiction and included such decision in the judgment;

(2) The decision on the request to repeat a procedure shall be made by the court which issued the decision to which the reasons for repetition refer.

Upon modification of the decision against which a means of ordinary judicial review has been lodged, or upon setting aside of such decision and rejection of the action, the court shall decide on the costs of the whole proceedings.

The action for annulment of the arbitration award shall be filed with the court of competent jurisdiction within a term of thirty days.

Copies of the arbitration award shall be served upon the parties by medium of the court specified in the third paragraph of Article 466 of the present Act.

(2) The decision on the request to repeat a procedure shall be made by the court, which issued the decision to which the reasons for repetition refer.

The legal remedies permitted against the ruling shall also be permitted against the decisions made by the court in the repeat procedure.

The judgements of the Court, as well as other decisions resolving fundamental issues before the Court, shall be published in the official languages.

Where an appeal is brought against a decision of the General Court, the procedure before the Court of Justice shall consist of a written part and an oral part.
