Če zaradi izločitve sodnika sodišče ne more postopati, sporoči okrajno ali okrožno sodišče to višjemu sodišču, višje sodišče pa vrhovnemu sodišču, ki odloči, da naj postopa v zadevi drugo stvarno pristojno sodišče z njegovega območja.
If the court cannot proceed due to exclusion of a judge, the district or circuit court shall notify thereon the high court which shall, in turn, notify accordingly the Supreme Court. Thereupon, the Supreme Court shall delegate the power to conduct the proceedings to another court from its territory with the competent jurisdiction over the subject-matter.

Tako kot se stranki strinjata s klavzulo 9 tega sporazuma, soglašata tudi, da za namen člena 1 Protokola, priloženega h Konvenciji o sodni pristojnosti in izvršbi sodb v civilnih in trgovskih zadevah, podpisani v Bruslju 27. septembra 1998, in brez poseganja v uresničevanje tega sporazuma s strani njegovih strank (sodelujoča stranka iz Luksemburga) izrecno in nedvoumno potrjuje tudi svoje strinanje z določbami klavzule 9 tega sporazuma, ki določajo, da je okrožno sodišče ( Landgericht ) v Frankfurtu na Maini pristojno za zaslišanje in odločitev v zvezi s katerokoli tožbo, dejanjem ali postopkom ter za reševanje sporov, do katerih lahko pride v zvezi s tem sporazumom, in se za te namene nepreklicno podreja pristojnosti teh sodišč.
In addition to clause 9 of this Agreement the Parties agree that for purpose of Article 1 of the Protocol annexed to the Convention on Jurisdiction and the Enforcement of Judgements in Civil and Commercial Matters, signed in Brussels on 27 September 1998 and without prejudice to the foregoing execution of this Agreement by the parties hereto, (Luxembourg Counterparty) expressly and specifically confirms its agreement to the provisions of clause 9 of this Agreement, stipulating that the District Court (Landgericht) of Frankfurt am Main shall have jurisdiction to hear and determine any suit, action or proceeding, and to settle any disputes, which may arise out of or in connection with this Agreement and, for such purposes, irrevocably submits to the jurisdiction of such courts.
