Article 3 Compensation for wrongful conviction

(2) The misdemeanour authority or court that issued the decision may at any point of time rectify spelling or numerical mistakes, and other manifest errors in the decision, which they shall effect ex officio or at the proposal by the parties to the proceedings.

In decisions of the European Patent Office, only linguistic errors, errors of transcription and obvious mistakes may be corrected.

The receiving Contracting Party shall correct any untrue data and immediately destroy any data delivered by mistake or improperly;

Linguistic errors, errors of transcription and mistakes in any document filed with the European Patent Office may be corrected on request.

The presiding judge may at any time correct mistakes in writing and computing, shortcomings in form, and discrepancies between the copy and original of the judgment.

(3) If the lawsuit was not submitted to the court but to some other body, and was received by the competent body after the deadline for filing it had passed, it shall be considered as having been filed on time if the act of filing it with some other body can be attributed to ignorance or to an obvious mistake on the part of the applicant.

The SAPARD Agency shall ensure that any amount(s) which it finds has been inadvertently paid in excess of the sum due, noted by it and which have been incorporated in expenditure declarations charged to the SAPARD euro account, are recorded within 5 days in the SAPARD euro account and deducted from the next application for payment to the Commission referred to in Article 9 of this Section.

Make no mistakes, this proposal originated in Slovenia.

A visa may also be cancelled by the consular authorities if the visa appears to have been issued in error.

If, by mistake, a voter is not enrolled in the electoral register, he may vote on the basis of a certificate issued by the competent body stating that he is enrolled as a voter in the area covered by the polling station at which he wishes to vote.

4.The repayment obligation referred to in paragraph 1 shall not apply if the payment was made by error of the competent authority or of another authority and if the error could not reasonably have been detected by the farmer.

Prebežniki thus became a label for the category of people who found themselves within the Slovene territory almost accidentally, by mistake one could say, and in doing so they violated Slovene laws because they crossed the border illegally.

Such analysis ensures that any injury caused by factors other than the dumped imports concerned is not wrongly attributed to those dumped imports.

However, it was found that the customs duty was erroneously omitted in the underselling calculations regarding two Indian exporting producers.

(18) An error has been found in the Annex to Decision 2003/42/EC in that the commercial document model for raw material destined for the production of collagen unintentionally requires a stamp of an official veterinarian.

This document was approved by the Vision subgroup of Working Group II on Movement of Persons on 31 March 1999 but, through an oversight, Decision SCH/Com-ex (94)15 rev. was not updated by the Executive Committe to take account of such approval before the integration of the Schengen acquis into the framework of the European Union.

To ensure fair treatment, conditions should be laid down to cover ineligible actions included in error by the producer organisation in an operational programme and approved by the Member State, whereby Member States should not be obliged to withhold aid payments or recover aid paid, in accordance with the jurisprudence of the Court of Justice.
