(1) Naročnik mora varovati kot zaupne vse podatke o ponudnikih, vsebovane v ponudbeni dokumentaciji in ki jih kot zaupne določa predpis o gospodarskih družbah ali drug predpis.
(1) Contractors shall safeguard as confidential all data on tenderers contained in the tender documentation which are defined as confidential by the regulation on commercial companies or any other regulation.

(3) Za izpolnjevanje obveznosti ponudnika do podizvajalcev ali ponudnikovih dobaviteljev lahko naročnik predpiše še dodatne pogoje. Sprejem teh pogojev mora ponudnik posebej potrditi v ponudbeni dokumentaciji.
(3) In order to fulfil liabilities of tenderers towards subcontractors, or tenderers' suppliers, contractors may prescribe additional conditions. The adoption of these conditions shall be explicitly confirmed by tenderers in their project documentation.

V primerih iz točk (b) in (c) se zadeve glede v ponudbi ponujenega premisleka, zlasti glede cene, in zadeve glede postopka ponudbe, zlasti informacij o odločitvi ponudnika za ponudbo, vsebine ponudbenega dokumenta in razkritja ponudbe, obravnavajo v skladu s pravili države članice, iz katere prihaja pristojni organ.
In the cases referred to in (b) and (c), matters relating to the consideration offered in the case of a bid, in particular the price, and matters relating to the bid procedure, in particular the information on the offeror's decision to make a bid, the contents of the offer document and the disclosure of the bid, shall be dealt with in accordance with the rules of the Member State of the competent authority.

(2) Naročnik sme poleg razpisne dokumentacije v slovenskem jeziku dovoliti uporabo tujih jezikov. V tem primeru pripravi razpisno dokumentacijo ali dele razpisne dokumentacije tudi v tujem jeziku. Naročnik lahko določi v razpisni dokumentaciji, da smejo ponudniki predložiti svoje ponudbe delno ali v celoti tudi v tujem jeziku, zlasti v delu, ki se nanaša na tehnične značilnosti, kakovost in tehnično dokumentacijo. Če naročnik dovoli, da ponudnik predloži del ponudbene dokumentacije v tujem jeziku, mora naročnik navesti, kateri del ponudbe je lahko v tujem jeziku.
(2) Contractors may decide to publish the contract documents in a foreign language in addition to Slovenian. In such case, a part or the whole contract document shall be prepared in that foreign language, as well. Contractors may allow in their tender documentation that tenderers may submit their tenders, in part or in full, also in another language, especially in the part related to technical characteristics, quality and technical documentation. If contractors allow tenderers to submit part of tender documentation in a foreign language, they shall specify which part of the tender may be in that foreign language.
