ATTESTATION OF CONFORMITY WITH TECHNICAL SPECIFICATIONS

The attestation of conformity of a product is dependention:

Compliance with the conditions in paragraph 6 shall be certified by the competent authority for milk intended for intra-Community trade.

Compliance with the conditions in paragraph 4 shall be certified by the competent authority for fresh meat intended for intra-Community trade.

Compliance with the conditions in paragraph 5 shall be certified by the competent authority for fresh meat, minced meat and meat preparations intended for intra-Community trade.

Compliance with the conditions provided for in paragraph 6, paragraph 8 and where applicable under the provisions of paragraph 10, shall be certified by the competent authority for fresh meat intended for intra-Community trade.

Conformity assessment procedures include, inter alia, procedures for sampling, testing and inspection; evaluation, verification and assurance of conformity; registration, accreditation and approval as well as their combinations.

Note: for products having more than one of the intended uses specified in the following families, the tasks for the approved body, derived from the relevant systems of attestation of conformity, are cumulative.

The procedure for attesting conformity as set out in Annex III shall be indicated in the relevant European technical approvals.

BODIES INVOLVED IN THE ATTESTATION OF CONFORMITY

The procedure for attesting conformity as set out in Annex III shall be indicated in mandates for guidelines for European technical approvals.

The Commission is required to select, as between the two procedures under Article 13(3) of Directive 89/106/EEC for attesting the conformity of a product, the least onerous possible procedure consistent with safety.

This means that it is necessary to decide whether, for a given product, the existence of a factory production control system under the responsibility of the manufacturer is a necessary and sufficient condition for an attestation of conformity, or whether, for reasons related to compliance with the criteria set out in Article 13(4), the intervention of an approval certification body is required.

When contractors, upon contracting a service, demand attestations to verify their conformity with the requirements of quality management and quality assurance issued by independent bodies to confirm that these services comply with specific standards, they shall make reference to a quality assurance system under the Slovenian standards series SIST EN ISO 9000, which fulfil the requirements from the Slovenian standards series SIST EN 45000.

Commission Decision 2001/634/EC of 16 August 2001 laying down special conditions governing imports of f ishery products originating or proceeding from Guinea(3) states that the "Direction nationale des pęches maritimes (DNPM) of the Ministčre de la pęche et de l'aquaculture" is to be the competent authority in Guinea for verifying and certifying compliance o f fishery and aquaculture products with the requirements of Directive 91/493/EEC.

Whereas Article 1 of Commission Decision 95/453/EC of 23 October 1995 laying down special conditions for the import of live bivalve molluscs, echinoderms, tunicates and marine gastropods originating in the Republic of Korea(3), states that the Ministry of Agriculture, Forestry and Fisheries - National Fishery Products Inspection Station (NFPIS) shall be the competent authority in the Republic of Korea for verifying and certifying compliance of fishery and aquaculture products with the requirements of Directive 91/492/EEC;

The European Parliament and Council invite the Commission to evaluate whether conformity assessment procedures for industrial products are properly applied and, where appropriate, to propose amendments in order to ensure consistent certification.

Continued development in measurement technology as well as concerns expressed by stakeholders about certification, stress the need to ensure consistent conformity assessment procedures for industrial products, as requested by the Council Resolution adopted on 10 November 2003(8).

From 1 October 2005, for new types, and from 1 October 2006, for all types, type-approvals granted to vehicles shall also require confirmation of the correct operation of the emission control devices during the normal life of the vehicle under normal conditions of use (conformity of in-service vehicles properly maintained and used).

Where they request the production of certificates drawn up by independent bodies attesting the compliance of the economic operator with certain quality assurance standards, contracting entities shall refer to quality assurance systems based on the relevant European standards series certified by bodies conforming to the European standards series concerning certification.

Commission Decisions 98/436/EC(4), 98/599/EC(5), 98/600/EC(6), 1999/90/EC(7), 2000/245/EC(8) and 2000/553/EC on the attestation of conformity of construction products for roof coverings that may be exposed to an external fire source provide that certain products/materials can be "deemed to satisfy" the requirements for the characteristic "external fire performance" without the need for testing.

In such cases, should the contracting entities require the production of certificates drawn up by independent bodies attesting the compliance of the economic operator with certain environmental management standards, they shall refer to the EMAS or to environmental management standards based on the relevant European or international standards certified by bodies conforming to Community law or the relevant European or international standards concerning certification.
