Če pri sodišču ni predvidena pravica do pritožbe ali če je pritožba mogoča le na pravno veljavnost odločbe, ali če pritožba ne zadrži izvršitve odločbe, upravni organ, razen v nujnih primerih, ne sme sprejeti odločbe, s katero se zavrne podaljšanje dovoljenja za prebivanje ali s katero se ukaže izgon imetnika dovoljenja za prebivanje z ozemlja države, dokler ne da mnenja pristojni organ države gostiteljice, pred katerim ima prizadeta oseba pravico do obrambe in pomoči ali do pravnega zastopanja, kot je predvideno v domači zakonodaji.
Where there is no right of appeal to a court of law, or where such appeal may be only in respect of the legal validity of the decision, or where the appeal cannot have suspensory effect, a decision refusing renewal of a residence permit or ordering the expulsion of the holder of a residence permit from the territory shall not be taken by the administrative authority, save in cases of urgency, until an opinion has been obtained from a competent authority of the host country before which the person concerned enjoys such rights of defence and of assistance or representation as the domestic law of that country provides for.

Švicarska vlada navaja svoje pričakovanje, da bo, če bosta statut in poslovnik Sodišča Evropskih skupnosti spremenjena tako, da bosta odvetnikom, ki imajo pravico zastopanja na sodiščih držav podpisnic podobnega sporazuma kot je ta, dovolila zastopanje na Sodišču Evropskih skupnosti, takšna sprememba vključevala tudi možnost, da švicarski odvetniki, ki delajo na švicarskih sodiščih, zastopajo na Sodišču Evropskih skupnosti v zvezi z vprašanji, ki so temu sodišču posredovana v skladu s tem sporazumom.
The Swiss Government indicates its expectation that, if the Statute and Rules of Procedure of the Court of Justice of the European Communities were to be amended in order to permit lawyers entitled to plead before the courts of States parties to a similar agreement as the present to plead before the Court of Justice of the European Communities, such amendment would also include the possibility for Swiss lawyers practising before the Swiss courts to plead before the Court of Justice of the European Communities in relation to the questions referred to that Court pursuant to this Agreement.
