Regulations of the Court

Upon appointment of counsel in accordance with the Statute, the Rules of Procedure and Evidence and the Regulations of the Court, counsel shall be provided with a certificate under the signature of the Registrar for the period required for the exercise of his or her functions.

A Tribunal established under the provisions of this Annex shall decide its own rules of procedure.

The Prosecutor and the Registrar shall be consulted in the elaboration of the Regulations and any amendments thereto.

The powers of the Court under Article 55 of the Convention shall extend to the drawing up of such rules and the determination of such procedure as the Court may think necessary for the purposes of this Protocol.

The Registrar, with the agreement of the Presidency and the Prosecutor, shall propose Staff Regulations which include the terms and conditions upon which the staff of the Court shall be appointed, remunerated and dismissed.

The judges shall, in accordance with this Statute and the Rules of Procedure and Evidence, adopt, by an absolute majority, the Regulations of the Court necessary for its routine functioning.

By the time the court rules are amended and supplemented, the operations of courts in the area of misdemeanour cases shall be subject to the applicability of the provisions of the Rules on Internal Operations of Authorities Responsible for Misdemeanour Proceedings (Uradni list SRS, Nos.

(4) Where the national law provides, in respect of the form or contents of national applications, for requirements which, from the viewpoint of applicants, are more favorable than the requirements provided for by this Treaty and the Regulations in respect of international applications, the national Office, the courts and any other competent organs of or acting for the designated State may apply the former requirements, instead of the latter requirements, to international applications, except where the applicant insists that the requirements provided for by this Treaty and the Regulations be applied to his international application.

Subject to Article 64(5), any dispute between two or more Contracting States concerning the interpretation or application of this Treaty or the Regulations, not settled by negotiation, may, by any one of the States concerned, be brought before the International Court of Justice by application in conformity with the Statute of the Court, unless the States concerned agree on some other method of settlement.

(1) Employees and former employees of the European Patent Office or their successors in title may apply to the Administrative Tribunal of the International Labour Organisation in the case of disputes with the European Patent Organisation in accordance with the Statute of the Tribunal and within the limits and subject to the conditions laid down in the Service Regulations for permanent employees or the Pension Scheme Regulations or arising from the conditions of employment of other employees.

Whereas it is necessary use of this possibility and to determine in the Rules of Procedure of the Court of First Instance the circumstances in which a single Judge may be called upon to give a decision in a case and the detailed rules in accordance with which a case may be heard by a single Judge,

Whereas it is a feature of the intellectual property field that it involves disputes between private parties; whereas it is therefore necessary in particular to adopt specific rules on the procedural rights of interveners and on the use of languages by private parties in the course of proceedings before the Court of First Instance in compliance with the Communities general rules governing the use of languages,

Rules concerning the members of the Court of First Instance and its organization

All co-financing contracts concluded under this Regulation shall provide for the Commission and the Court of Auditors to conduct on-the-spot checks according to the usual procedures laid down by the Commission under the rules in force, and in particular those of the Financial Regulation applicable to the general budget of the European Communities.
