(Cessation of validity of ZGO and individual provisions)

In respect of investments made prior to the date of termination of this Agreement the provisions of Articles 1 to 15 shall remain in force for a further period of five (5) years from the date of termination of this Agreement.

In respect of investments made prior to the date of termination of this Agreement the provisions of Articles 1 to 15 shall remain in force for a further period of ten (10) years from the date of termination of this Agreement.

In respect of investment made prior to the date of termination of this Agreement the provisions of Articles 1 to 12 shall remain in force for a further period of ten (10) years from the date of termination of this Agreement.

In respect of investment made prior to the date of termination of this Agreement the provisions of Articles 1 to 14 shall remain in force for a further period of twenty (20) years from the date of termination of this Agreement.

(3) If the sum of individual penalty points reaches the number of points for which the sanction of driving licence revocation is imposed, the aggregate sanction shall impose the sanction of driving licence revocation.

In respect of investments made prior to the date of termination of this Agreement the provisions of Articles 1 to 11 shall remain in force for a further period of fifteen (15) years from the date of termination of this Agreement.

Upon termination of the exemption, any remaining stocks of the substance are subject to the provisions of article 3, paragraph 1 (b).

The provisions of this Agreement shall continue to be applicable after its termination to the extent necessary to permit an orderly disposal of assets and settlement of accounts.

However, a tariff may be prolonged after its original date of expiration for a period not exceeding twelve (12) months.

19.3 In the event of withdrawal or termination from this MOU, Section IX will remain in effect and provisions of Sections VII and XV will remain effective until all responsibilities are fully settled.

Notwithstanding termination of this Agreement, all reimbursement obligations incurred pursuant to its terms shall remain binding on the responsible Party until satisfied.

The provisions of this Agreement shall apply ten years after its termination to all contracts entered into during the period of the validity of this Agreement but not fully completed on the day of termination of this Agreement.

(4) The law may prescribe that individual types of drivers shall be imposed the sanction of driving licence revocation for collecting a lower or higher number of penalty points in road use.

10.2 All provisions of Sections 6, 7, and 9 will remain in effect in the event of withdrawal of any Contracting Party or upon termination of this MOU until all obligations are fulfilled.

Unless otherwise stipulated, the termination of this Agreement shall not affect the validity or duration of any arrangements or any rights and obligations established under it.

All classified information that have been exchanged or arouse in compliance with this Agreement, shall be protected according to the provisions of this Agreement even after repudiation of the agreement, until their nature and classification require so.

(3) Notwithstanding the provisions of paragraphs 1 and 2 of this article, the secondary sanctions of seizure of items and penalty points in road use with driving licence revocation may be imposed on a juvenile in addition to a correctional measure or fine.

Provisions in the laws of the Contracting Parties concerning the prescription and the termination of the right to cash benefits shall not apply to rights arising out of the provisions of paragraph 1 of this Article, provided that the beneficiary submits his application for a benefit within two years after the date of entry into force of this Convention.

C. All information protected by provisions of this Arrangement as proprietary or other confidential or privileged information will remain so protected for the duration of this Arrangement and after this Arrangement is expired or terminated, unless otherwise agreed by the Parties in writing.

If the Agreement ceases to have effect on account of such termination, its provisions shall nevertheless continue to apply for the period and to the extent necessary to secure the implementation of any specific implementing arrangements concluded pursuant to Article 3.1 above and still effective on the date upon which the present Agreement ceases to have effect.

All acts by or on behalf of the Organization or any of its organs under the International Tropical Timber Agreement, 1983, and/or the International Tropical Timber Agreement, 1994, which are in effect on the date of entry into force of this Agreement and the terms of which do not provide for expiry on that date shall remain in effect unless changed under the provisions of this Agreement.

(3) Application mutatis mutandis of the provisions of a concession contract in compliance with the act regulating commercial public services, or of the provisions of an equity partnership contract, shall be valid for the concluding of contracts, the substance of the partnership, the validity of contracts and their unilateral amendment, the rights and obligations of the public partner and contractor of a public-private partnership (orders for concessionaire works etc.), and for the transfer and termination of such relationships.

(1) With regard to the conclusion of a concession contract and the substance of the concession relationship, the validity of the contract and unilateral changes thereof, the rights and obligations of the public partner and contractor of a public-private partnership and the transfer and termination of the concession relationship, the provisions of the act regulating commercial public services, in that part relating to concession relationships, shall apply mutatis mutandis.

The Record shall be kept for the purpose of recording and processing data on perpetrators of misdemeanours on whom penalty points have been imposed for committing misdemeanours in road use, and the number of penalty points, and for the purpose of recording data on drivers on whom the sanction of cessation of validity of their driving licence has been imposed because they achieved or exceeded the legally specified number of penalty points in road use.

(1) With regard to the conclusion of an equity partnership contract and the substance of the equity partnership, the validity of the contract and unilateral changes thereof, the rights and obligations of the public partner and equity partnership contractor (for instance orders by works concessionaires) and the transfer and termination of the public-private partnership, the provisions of the act regulating commercial public services, in that part relating to concession relationships, shall apply mutatis mutandis.

SUBJECT TO THE PROVISIONS OF THIS ARTICLE, THE PROVISIONS OF ARTICLE 3 SHALL, WITH THE EXCEPTION OF PARAGRAPHS 4 AND 5, APPLY TO THE TIMES AND PERIODS OF ENTRY INTO FORCE, TAKING EFFECT, APPLICATION, EXPIRY OF VALIDITY, TERMINATION OF EFFECT OR CESSATION OF APPLICATION OF ACTS OF THE COUNCIL OR COMMISSION OR OF ANY PROVISIONS OF SUCH ACTS.

EXPIRY OF VALIDITY, THE TERMINATION OF EFFECT OR THE CESSATION OF APPLICATION OF ACTS OF THE COUNCIL OR COMMISSION _ OR OF ANY PROVISIONS OF SUCH ACTS _ FIXED AT A GIVEN DATE SHALL OCCUR ON THE EXPIRY OF THE LAST HOUR OF THE DAY FALLING ON THAT DATE.

On expiry of this Agreement, Member States shall still be obliged to pay, as provided in Article 6 and in the Financial Regulation referred to in Article 32, the portion of their contributions not yet called for.

The reduction specified in the authorisation may be applied after 31 December 2003 until the expiry of the authorisation.

Before the expiry of the 9th EDF, the Member States shall set a date beyond which the funds of the 9th EDF may no longer be committed.

Similarly, after the date of the expiry of the ECSC Treaty, pending anti-dumping applications should be dealt with pursuant to the provisions of the basic anti-dumping Regulation.

The rights and obligations acquired by undertakings by virtue of Articles 4 and 5 of this Agreement and of the rules of Council Regulation (EEC) No 2407/92 as included in the Annex to this Agreement, shall not be affected by the termination of this Agreement under the provisions of Article 36(4).

This would be particularly damaging for the Community industry which managed to survive and restructure despite the presence of some dumped imports, albeit fewer than would be the case should the present measure expire, and the high fluctuation in the price of oil.

On termination of existing sectoral cooperation agreements and memoranda of understanding between the Parties, as provided for in these agreements and memoranda, the Parties will review the situation with a view to including the activities covered by such agreements and memoranda within this Agreement.

Any pending anti-dumping investigation should, after the date of the expiry of the ECSC Treaty, be continued and concluded pursuant to the provisions of the basic anti-dumping Regulation and any antidumping measures resulting from such an investigation should be subject to the provisions of the basic anti dumping Regulation.

Any pending anti-subsidy investigation should after the date of the expiry of the ECSC Treaty be continued and concluded pursuant to the provisions of the basic anti-subsidy Regulation and any countervailing measures resulting from such an investigation should be subject to the provisions of the basic anti-subsidy Regulation.

Amendments to the Annexes to this Regulation which may be necessary to take into account the conclusion, amendment or expiry of agreements or arrangements with third countries or amendments made to Community rules on statistics, customs arrangements or common rules for imports shall be adopted in accordance with the appropriate procedure provided for in Article 25.

It is therefore also appropriate to provide for the continued application of ECSC countervailing measures under Council Regulation (EC) No 2026/97 on protection against subsidised imports from countries not members of the European Community (basic anti-subsidy Regulation) ( fn ) after the date of the expiry of the ECSC Treaty and to apply from then onwards the provisions of the basic anti-subsidy Regulation to such measures.
