The introduction of the quota system shall be linked to the simultaneous provision of expert, technical and material support to employers and shall start from the zero-sum basis.

The Joint Committee referred to in Article 14 hereof determines the qupta, category, conditions of issue and use of blank permit forms as well as the conditions under which individual categories of transport may be exempted from the permit system.

Commission Regulation (EEC) No 1443/82 of 8 June 1982 laying down detailed rules for the application of the quota system in the sugar sector(2), as last amended by Regulation (EC) No 392/94(3), having, moreover, already been substantially amended a number of times, in the interests of clarity that Regulation should be recast.

In order to keep the Community market open and ensure the availability of adequate supply to meet demand it is appropriate to establish a system of tariff quotas in excess of which an additional duty requires to be paid so that even imports in excess of the tariff quotas can enter the Community, albeit upon payment of an additional duty.

The "windfall" effects of the allocation of the tariff quotas on a first-come-first-served basis risk harming Community producers as demand will be focused on imports from PRC in the early part of the canning season and will only transfer to the Community producers' product after the tariff quota is exhausted.
