Je z namenom krepitve skupne zunanje in varnostne politike (SVZP) in zlasti skupne evropske varnostne in obrambne politike, predvidene v členu 17 Pogodbe o Evropski uniji, Evropski svet na sestanku v Nici med 7. in 11. decembrom 2000 dosegel dogovor o ustanovitvi Vojaškega štaba Evropske unije in določil njegov namen in funkcije.
In the framework of the strengthening of the common foreign and security policy (CFSP) and in particular of the common European policy on security and defence provided for in Article 17 of the Treaty on European Union, the European Council meeting in Nice on 7-11 December 2000 reached agreement on the establishment of the Military Staff of the European Union, setting out its mission and functions.

V primerih izvenpogodbene odgovornosti vso škodo, ki nastane zaradi operacije, glavnega štaba, štaba vojaških sil (force headquarters) in štaba komponent (component headquarters) krizne strukture, katere sestavo odobri poveljnik operacije, ali ki jo povzročijo člani njihovega osebja pri opravljanju svojih nalog, krijejo države plačnice prek ATHENE, v skladu s splošnimi načeli, ki so skupna zakonom držav članic in kadrovskim pravilnikom za vojaške sile, ki veljajo na območju izvajanja operacij.
In the case of non-contractual liability, any damage caused by the operation, headquarters, force headquarters and component headquarters of the crisis structure, the composition of which shall be approved by the operation commander, or by their staff in the course of their duties shall be covered through ATHENA by the contributing States, in accordance with the general principles common to the laws of the Member States and the Staff Regulations of the forces, applicable in the theatre of operations. 5.

Upravičeni skupni stroški se določijo v skladu s Prilogo III ob upoštevanju dejstva, da člani potrebnega osebja, ki pripravljajo obračun, pripadajo štabu zadevne operacije tudi potem, ko je ta prenehal s svojimi aktivnostmi.
