Joint financing by the applicant States is systematically required for all investment projects.

(Financing of the State and Local Communities)

The financial commitment of the Community shall be set out in the Annual Financing Agreements.

Responsibility for the funding of the SECI Center's budget shall be established by the Joint Cooperation Committee.

5.2.2 A system of funding, budget planning, and supervision of expenses shall be developed and approved by the Joint Cooperation Committee.

This Agreement sets out the Community financial commitment for the Republic of Slovenia for the year 2001. It also modifies the Multi-annual Financing Agreement signed on 5.03.2001, as well as the Annual Financing Agreement 2000 signed on 5.03.2001.

(3) The Multi-Annual Financing Agreement between the Community and the Republic of Slovenia has been concluded on 28 August 2001 and provides in Article 2 that the financial commitment of the Community shall be set out in Annual Financing Agreements;

All revenues and expenditures of the state and local communities for the financing of public spending must be included in their budgets.

This commitment is valid only for execution of the Programme in conformity with the Multi-annual Financing Agreement between the Community and the Republic of Slovenia.

This Agreement sets out the Community financial commitment for the Republic of Slovenia for the year 2003. It also modifies the Multi-annual Financing Agreement signed on 5 March 2001, as amended, as well as the Annual Financing Agreements 2000, 2001 and 2002.

c. The NATO Commander will determine whether Common Funding is available and which requirements are eligible for Common Funding.

Member States participating in the Agency shall jointly guarantee payment of such benefits in accordance with the scale laid down for financing such expenditure.

(3) The Multi-annual Financing Agreement between the Commission acting on behalf of the Community and the Republic of Slovenia, as last amended by the Annual Financing Agreement 2002 between the Commission acting on behalf of the Community and the Republic of Slovenia (hereinafter referred to as ` MAFA` ), has been concluded on 28 August 2001 and provides in Article 2 that the financial commitment of the Community shall be set out in Annual Financing Agreements;

All interest attributable to the Community contribution shall be additional to the amounts included in the Annual Financing Agreements and shall be counted as a further contribution by the Community.

Promote and support, by funding or otherwise, joint industrial research and development activities between Entities from Slovenia and Israel;

This commitment is valid only for execution of the Programme, as amended, in conformity with the Multi-annual Financing Agreement between the Community and the Republic of Slovenia.

(6) In the light of experience gained since signature of the Multi-Annual Financing Agreement between the Community and the Republic of Slovenia, it appears necessary to make certain adjustments to that agreement;

From 1 January 1978, financing shall be on a basis to be determined, during a study to be initiated on 1 January 1977, in the light of developments in the European Communities by that date and the alternative of financing by the Community.

Community budget commitments for the Republic of Slovenia shall be made in the Commission accounts on the basis of the Commission decision authorising signature of each Annual Financing Agreement.

(c) increased flexibility in project design, funding and implementation in keeping with the experimental, iterative approach indicated for participatory action at the local community level; and

Monitoring shall be carried out by reference to physical, environmental and financial indicators and include data to demonstrate that Community funds have not replaced funding available in the Republic of Slovenia.

(c) expenditure by measure must be consistent with the Programme including, where appropriate, flexibility between measures and within the limit of the Community contribution pursuant to the concluded Annual Financing Agreement;

The total cost of the Project is intended to be financed, inter alia, with an ISPA grant (hereinafter the ` ISPA Grant` ) in an amount equivalent to EUR 28 million and with EIB financing in an amount equivalent to EUR 34 million.

(5) The Annual Financing Agreement 2000 between the Community and the Republic of Slovenia sets the date of 31 December 2002 as the time limit of validity of the 2000 annual commitment. Since no Commission Decision conferring management of the SAPARD instrument on Agencies in the Republic of Slovenia has been taken in 2000, it is appropriate to modify Article 3 of the Annual Financing Agreement 2000, extending the period of commitment until 31 December 2003;

The Republic of Slovenia shall make available to the Commission all information required for the proper working of the Programme and shall take all suitable action to facilitate the supervision which the Commission considers necessary within the framework of the management of Community financing, including inspections on-the-spot.

Payment by the Commission of the Community contribution shall be made in accordance with the Annual Financing Agreement(s) referred to in Article 2 of this Agreement to the SAPARD euro account and provided that the verifications referred to in Article 9 of this Section have not indicated any problems.

The Communities shall be allocated own resources in accordance with the rules laid down in the following Articles in order to ensure, in accordance with Article 269 of the Treaty establishing the European Community (hereinafter referred to as "the EC Treaty") and Article 173 of the Treaty establishing the European Atomic Energy Community (hereinafter referred to as "the Euratom Treaty"), the financing of the general budget of the European Union.

INTERNAL AGREEMENT BETWEEN REPRESENTATIVES OF THE GOVERNMENTS OF THE MEMBER STATES, MEETING WITHIN THE COUNCIL, ON THE FINANCING OF COMMUNITY AID UNDER THE MULTI-ANNUAL FINANCIAL FRAMEWORK FOR THE PERIOD 2008-2013 IN ACCORDANCE WITH THE ACP-EC PARTNERSHIP AGREEMENT AND ON THE ALLOCATION OF FINANCIAL ASSISTANCE FOR THE OVERSEAS COUNTRIES AND TERRITORIES TO WHICH PART FOUR OF THE EC TREATY APPLIES

Moreover, to reflect the provisions of Commission Regulation (EC) No 2222/2000 of 7 June 2000 laying down financial rules for the application of Council Regulation (EC) No 1268/1999 on Community support for pre-accession measures for agriculture and rural development in the applicant countries of central and eastern Europe in the pre-accession period, as last amended by Regulation (EC) No 188/2003 it is necessary to the increase the time limits of validity of financial commitments set out in the Annual Financing Agreements for 2000, 2001 and 2002. For the same reason it is also necessary to adjust the provisions in the Multi-annual Financing Agreement concerning the submission of applications for payment from the Commission;

(9) On 12 September 2000, the Representatives of the Governments of the Member States, meeting within the Council adopted an Internal Agreement on the financing and administration of Community Aid under the Financial Protocol to the ACP-EC Partnership Agreement and the allocation of financial assistance for the Overseas Countries and Territories to which Part Four of the EC Treaty applies (hereinafter referred to as the »Internal Agreement for the 9th EDF«)(10).

Paragraph 1 shall not apply to expenditure under the European Agricultural Guidance and Guarantee Fund, Guarantee Section, according to Articles 2(1), 2(2), and 3(3) of Council Regulation (EC) No 1258/1999 of 17 May 1999 on the financing of the common agricultural policy, which will become eligible for Community funding only from 1 May 2004, in accordance with Article 2 of this Protocol.

The European Community undertakes to channel its support either through the financing mechanisms of the region or through those chosen by the countries signatory to this Agreement in accordance with the rules and procedures set out in the Cotonou Agreement and in compliance with the aid effectiveness principle of the Paris Declaration, with a view to ensuring simplified, efficient and rapid implementation.

The Council shall adopt a European decision establishing the specific procedures for guaranteeing rapid access to appropriations in the Union budget for urgent financing of initiatives in the framework of the common foreign and security policy, and in particular for preparatory activities for the tasks referred to in Article I-41(1) and Article III-309. It shall act after consulting the European Parliament.

In mobilizing financial resources, the Parties shall seek full use and continued qualitative improvement of all national, bilateral and multilateral funding sources and mechanisms, using consortia, joint programmes and parallel financing, and shall seek to involve private sector funding sources and mechanisms, including those of non-governmental organizations.

European Community financing(4) pertaining to development cooperation between the Ivorian Party and the European Community in support of the implementation of this Agreement shall be provided in accordance with the appropriate rules and procedures set out in the Cotonou Agreement, in particular the programming procedures of the European Development Fund (EDF), and using the relevant instruments financed by the General Budget of the European Union.

Global budget commitments made before 1 May 2004 under the pre-accession financial instruments referred to in paragraph 1, including the conclusion and registration of subsequent individual legal commitments and payments made after 1 May 2004, shall continue to be governed by the rules and regulations of the pre-accession financing instruments and be charged to the corresponding budget chapters until closure of the programmes and projects concerned.

Give expression to the initiative by establishing a framework for financial support under which the Parties shall support jointly approved industrial R&D cooperation projects in the field of industrial R&D undertaken by Entities from Slovenia and Israel, for joint development and subsequent joint management and marketing of products or processes based on new innovative technologies to be commercialized in the global market (hereinafter referred to as "Projects").

The provisions of the Constitution shall be without prejudice to the competence of Member States to provide for the funding of public service broadcasting insofar as such funding is granted to broadcasting organisations for the fulfilment of the public service remit as conferred, defined and organised by each Member State, and insofar as such funding does not affect trading conditions and competition in the Union to an extent which would be contrary to the common interest, while the realisation of the remit of that public service shall be taken into account.

The Guarantors are parties to the Guarantee Agreement concluded with the Bank (hereafter called the “Guarantee Agreement” or “Guarantee”) in respect of the Loans made by the Bank from its own resources under the Internal Agreement of 17 July 2006 (hereafter called the “Cotonou Internal Agreement II”) relating to the financing of Community aid under the multi-annual financial framework for the period 2008 to 2013 in accordance with the Partnership Agreement signed in Cotonou (Benin) on 23 June 2000 between the European Community and its Member States and the African, Caribbean and Pacific States as revised in Luxembourg on 25 June 2005 (hereafter called the “Cotonou Partnership Agreement II”) and on the allocation of financial assistance for the Overseas Countries and Territories to which part four of the EC Treaty applies under Council Decision 2001/822/EC of 27 November 2001 on the association of the Overseas Countries and Territories (hereafter called the “Association Decision”) (together referred to herein as the “Cotonou Framework”).
