A revision may always be filed against a decree by which the court of second instance has rejected the appeal, or affirmed the judgment of the court of first instance rejecting the revision.

Relevant bodies of the states of the Parties are obliged to inform each other about any changes in the certificate on security clearances and the certificate on industrial security which are connected with the activities performed according to this Agreement, especially if they were revoked or the classification level was decreased.

(1) Before concluding a classified contract the relevant body of the state of the releasing Party shall request from the relevant body of the state of the receiving Party written information that the contactor has a certificate on industrial security of the relevant level.

The Competent Security Authority of one Party, wishing to place a classified contract with a contractor in the country of the other Party, or wishing to authorize one of its own contractors to place a classified contract in the country of the other Party within a classified project, shall obtain a prior written assurance from the Competent Security Authority of the other Party that the proposed contractor holds a security clearance of appropriate level and has the facilities to handle and store classified information of the same level.

Articles 5(2) and 7(2) of Commission Regulation (EC) No 1520/2000(2) provide a system for advance fixing of the rate of refund applicable to goods exported during the validity period of a refund certificate.

Furthermore, the investigation did not confirm the 25 % price difference between the two levels of trade.
