In the light of the results of these reviews, within the framework of their respective agricultural policies and taking into account the results of the Uruguay Round, the Contracting Parties will decide, within the framework of this Agreement, on a preferential, bilateral or multilateral, reciprocal and mutually beneficial basis, on further reductions of any type of barriers to trade in the agricultural sector, including those resulting from State monopolies of a commercial character in the agricultural field.

In the framework of the World Trade Organisation (WTO), the Community has undertaken to open tariff quotas for certain products in the egg sector and for egg albumin.

For example, in the Helsinki Agreement decision the Commission found the directly relevant market to be that of foreign Eurocheques drawn in the trading sector in France (4).

Whereas, however, in order to ensure that trade relations in this sector do not become excessively rigid, a second tranche should be made available to exporters who can prove that they are seriously engaged in trade;

Whereas, in order to avoid forcing trade relations in this sector into an excessively rigid mould, a second tranche should be made available to importers who are able to show that they are engaged in genuine trade of some scale with third countries;

It is expedient to apply such a procedure in order to facilitate the Community's decision-making process without changing the respective roles of the Commission and the Council in the application of the Basic Regulations, and without implying any changes for the decision-making procedures in other areas of the common commercial policy or other sectors.

Taking into account the specific problems of the agricultural sector in Poland, the measures taken by the Commission to prevent market disturbances under the general economic safeguard clause may include systems of monitoring of trade flows between Poland and other Member States.

Having regard to Council Regulation (EC) No 3290/94 of 22 December 1994 on the adjustments and transitional arrangements required in the agricultural sector in order to implement the agreements concluded during the Uruguay Round of multilateral trade negotiations(3), as last amended by Regulation (EC) No 1340/98(4), and in particular Article 3(1) thereof,

Having regard to Council Regulation (EC) No 3290/94 of 22 December 1994 on the adjustments and transitional arrangements required in the agricultural sector in order to implement the agreements concluded during the Uruguay Round of multilateral trade negotiations(3), as last amended by Regulation (EC) No 1340/98(4), and in particular Article 3(1) thereof,

The first sentence of Article 5(1) of Regulation (EC) No 94/2002 is hereby replaced by the following: "With a view to implementing measures contained in programmes as referred to in Article 6 of Regulation (EC) No 2826/2000, the Community trade federations or interbranch organisations that are representative of the sector(s) concerned shall submit programmes in response to calls for proposals issued by the Member States concerned before 31 March the first time and before 15 June thereafter."

Council Regulation (EC) No 2007/2000 of 18 September 2000 introducing exceptional trade measures for countries and territories participating in or linked to the European Union's Stabilisation and Association process, amending Regulation (EC) No 2820/98, and repealing Regulations (EC) No 1763/1999 and (EC) No 6/2000(3), as last amended by Commission Regulation (EC) No 2487/2001(4), Council Decision 2001/330/EC of 9 April 2001 on the conclusion of the Interim Agreement on trade and trade-related matters between the European Community, of the one part, and the former Yugoslav Republic of Macedonia, of the other part(5), and Council Decision 2001/868/EC of 29 October 2001 concerning the signing on behalf of the Community and the provisional application of the Interim Agreement on trade and trade-related matters between the European Community, of the one part, and the Republic of Croatia, of the other part(6), provide for the import of sugar sector products into the Community without quantity restrictions and exempt from customs duties.

(q) 'sector' means the production and trade structure for a product or category of products in a Party;

The Parties shall agree on the scope of cooperation in trade matters without excluding any sector.

The Parties shall encourage economic, commercial, scientific and technical cooperation in the fisheries and related sectors.

In the framework of the World Trade Organization, the Community has undertaken to open tariff quotas for certain products in the egg sector and for egg albumin.

In the framework of the World Trade Organisation, the Commission committed itself to increasing tariff quotas for certain products in the pigmeat sector.

Whereas, the Community has undertaken, in the context of the World Trade Organization, to open tariff quotas for certain products in the poultrymeat sector;

(7) The introduction of specific measures for the Community in the sector of ethyl alcohol of agricultural origin requires the establishment of trade arrangements at the Community's external borders.

(c) the fact that World Trade Organisation ("WTO") unfair trade disciplines are difficult to apply in the shipbuilding sector;

(2) In the framework of the World Trade Organisation (WTO), the Community has undertaken to open tariff quotas for certain products in the egg sector and for egg albumin.

The Parties agree that this Memorandum of Understanding is without prejudice to the possibility of seeking mutual concessions concerning market access from other trading partners in the sector.

The investigation showed that the selling, general and administrative expenses for the domestic producer referred to in the provisional duty Regulation related to sales in the same business sector.

Whereas, in order to take account of commercial practices specific to the cereals sector, detailed rules, additional to or derogating from the provisions of Regulation (EEC) No 2958/93, should be laid down;

the promotion of cooperation in the sectors of health, veterinary and animal plant matters, aiming at dismantling trade barriers, in accordance with the legislation of the Parties to the agreement,

Whereas by Regulation (EC) No 3290/94(1) the Council has adopted the adjustments and transitional arrangements required in the agricultural sector in order to implement the agreements concluded in the context of the Uruguay Round of multilateral trade negotiations, in particular the new trading arrangements with third countries in the fruit and vegetable sector;

study and devise ways of overcoming trade barriers, in particular non-tariff and quasi-tariff barriers in various sectors of trade, taking into account the principles and commitments agreed to by the two Contracting Parties within international bodies and the relevant work undertaken in this field by the international organizations concerned with such problems;

(a) The Group shall analyse and process jute trade information and statistics collected from the Food and Agriculture Organisation of the United Nations (FAO), other international and national institutions and the private sector.

The fishing industry shall grade fishery products for freshness categories Extra, A and B and size in collaboration with experts designated for that purpose by the trade organizations concerned.

(4) The negotiated concessions in the fisheries sector modify the bilateral concessions granted under the Agreement, which should, therefore, be amended by means of a Protocol adjusting the trade aspects of the Europe Agreement.

Whereas the measures covered by this Regulation fall within the competence of the European Community and they are both necessary and appropriate in order to complete the common commercial policy and to safeguard the measures already taken by the Community in the textile and clothing sector;

Whereas, as a result of the completion of GATT Uruguay Round negotiations on the integration of the textile and clothing sector into normal World Trade Organization rules and disciplines, it is necessary that the exceptions and derogations resulting from the remaining national commercial policy measures should be suspended until such time as the products in question have been integrated in accordance with that Agreement;

(a) to study and devise ways of overcoming trade barriers and in particular existing non-tariff and quasi-tariff barriers in the various sectors of trade, taking into account the work undertaken in this field by the international organizations concerned;

Whereas, as a result of the Agreement on Agriculture concluded as part of the Uruguay Round of multilateral trade negotiations, hereinafter referred to as 'the Agreement', certain Community rules on imports in the sugar sector need to be adjusted from 1 July 1995;

Having regard to Council Regulation (EC) No 3290/94 of 22 December 1994 on the adjustments and transitional arrangements required in the agricultural sector in order to implement the agreements concluded during the Uruguay Round of multilateral trade negotiations, and in particular Article 3 (1) thereof,

Commission Regulation (EC) No 1474/95 fn, as last amended by Regulation (EC) No 1356/2000 fn, opens and provides for the administration of the tariff quotas in the egg sector and for egg albumin resulting from the agreements concluded during the Uruguay Round of multilateral trade negotiations.

In order not to disrupt the sectors concerned and so as to ensure the harmonious development of production, the reduction should be staggered over two years, even though this might mean continuing to study trade flows, and taking account of the economic aspect of the planned aid.

(6) It is expedient to apply such a procedure in order to facilitate the Community's decision-making process without changing the respective roles of the Commission and the Council in the application of the Basic Regulations, and without implying any changes for the decision-making procedures in other areas of the common commercial policy or other sectors.

Whereas, as a result of the Agreement on Agriculture concluded as part of the Uruguay Round of multilateral trade negotiations, hereinafter referred to as 'the Agreement', certain Community rules on imports need to be adjusted from 1 July 1995 in the sugar sector, and in particular with regard to molasses;

Having regard to Council Regulation (EC) No 3290/94 of 22 December 1994 on the adjustments and transitional arrangements required in the agriculture sector in order to implement the agreements concluded during the Uruguay Round of multilateral trade negotiations (3), and in particular Article 3 thereof,

To this end, the two Parties shall, in particular, utilize the possibilities offered by the 1976 Framework Agreement for commercial and economic cooperation between Canada and the European Communities in the fisheries sector with a view to improving in a reciprocal manner the conditions and terms of their fisheries relations.

The Contracting Parties undertake to strengthen and diversify their cooperation in all areas of common interest, particularly the economic, financial, commercial, social, science and technology and environmental sectors, bearing in mind the lesser degree of development of the Central American countries.

To that end, the European trade organisations should be given help in preparing meetings of the ACFA with a view to stimulating comprehensive study of the issues involved in the CFP and the impact of its measures, fostering initiatives from the industry and seeking, if possible, common positions on Commission draft proposals.

The Commission informed all Member States of the alleged situation and consulted with them on the terms and conditions of imports, import trends and the serious injury or threat thereof to each of the sectors concerned, and the various aspects of the economic and commercial situation with regard to the Community products in question.

The Parties, recognising that the use of electronic means increases trade opportunities in many sectors, agree to promote the development of electronic commerce between them, in particular by cooperating on the market access and regulatory issues raised by electronic commerce.
