Keeping the person in detention

(b) The person being transferred shall remain in custody.

As regards persons under detention, the exercise of this right shall in particular imply that:

If the person in question is still being held after expiry of this period, he shall be released.

Upon expiry of the time limits referred to in paragraphs 2 to 4, if the person is still being held in custody he shall be released.

(a) Unless the Trial Chamber orders otherwise, a convicted person shall remain in custody pending an appeal;

After the deadline laid down in paragraph 1, if the person is being held, he shall be released on the territory of the requested State.

In imposing a sentence of imprisonment, the Court shall deduct the time, if any, previously spent in detention in accordance with an order of the Court.

The Pre-Trial Chamber shall ensure that a person is not detained for an unreasonable period prior to trial due to inexcusable delay by the Prosecutor.

If the Pre-Trial Chamber is satisfied that the conditions set forth in article 58, paragraph 1, are met, the person shall continue to be detained.

(a) The Court may request the temporary transfer of a person in custody for purposes of identification or for obtaining testimony or other assistance.

The time spent in custody in the territory of the requesting State pending prosecution in that State may be deducted from the time remaining to be served in the requested State.

The time spent in custody in the territory of the requesting country pending prosecution in that country may be deducted from the time remaining to be served in the requested country.

If such a question is raised in a case pending before a court or tribunal of a Member State with regard to a person in custody, the Court shall act with the minimum of delay.

(d) The person transferred shall receive credit for service of the sentence being served in the State from which he or she was transferred for time spent in the custody of the State to which he or she was transferred.

When a person is arrested on the basis of an arrest warrant, the executing judicial authority shall take a decision on whether the requested person should remain in detention, in accordance with the law of the executing State.

Remuneration may continue to be withheld in part after the six-month deadline referred to in paragraph 2, if the staff member concerned is the subject of criminal proceedings for the same acts and is in custody as a result of those proceedings.

(a) The State to which the person is transferred shall have the authority and obligation to keep the person transferred in custody, unless otherwise requested or authorized by the State from which the person was transferred;

After transfer, the said person shall not be kept in custody by the requesting State if the condition set out in Article 33, paragraph 2.a, is met or if the requesting State does not request enforcement of a further sentence.

(b) When a convicted person's time in custody exceeds the sentence of imprisonment imposed, that person shall be released, except that if the Prosecutor is also appealing, the release may be subject to the conditions under subparagraph (c) below;

(a) The State Party to which the person is transferred shall have the authority and obligation to keep the person transferred in custody, unless otherwise requested or authorized by the State Party from which the person was transferred;

(2) The time of detention of an accused person who has been detained during criminal proceedings shall be included in the fine imposed for a misdemeanour if he has not been convicted of committing a criminal offence and at the same time he has been imposed, for committing the same act, a fine within the framework of misdemeanour proceedings, where one day of detention shall be equivalent to SIT 10,000 within the fine.

(i) Under exceptional circumstances, and having regard, inter alia, to the concrete risk of flight, the seriousness of the offence charged and the probability of success on appeal, the Trial Chamber, at the request of the Prosecutor, may maintain the detention of the person pending appeal;

Any person who is taken into custody or regarding whom any other measures are taken or proceedings are carried out pursuant to this Convention shall be guaranteed fair treatment, including enjoyment of all rights and guarantees in conformity with the law of the State in the territory of which that person is present and applicable provisions of international law, including international human rights law.

The person in custody shall in any event be released:

A person who is being detained or is serving a sentence in the territory of one State Party whose presence in another State Party is requested for purposes of identification, testimony or otherwise providing assistance in obtaining evidence for the investigation or prosecution of offences set forth in article 2 may be transferred if the following conditions are met:

(b) may decide to amend Recommended Practices or to incorporate new Recommended Practices to Specific Annexes or Chapters therein in accordance with Article 16;

The Commission shall state what measures it recommends the Member State concerned to adopt.

Such recommended system shall be presented for consideration by the Meeting of the Parties.

HAS LAID DOWN THESE PROVISIONS, WHICH IT RECOMMENDS TO THE MEMBER STATES FOR ADOPTION:

For this purpose it shall make recommendations and take decisions in the cases provided for in this Agreement.

The EU encourages Croatia to fully take into account recent GRECO recommendations in this regard.

In this regard, the panel shall specify in its recommendation the time period within which the measure must be withdrawn.

Their conclusions shall take the form of resolutions, decisions, recommendations or reports.
