(2) The requirements in the legislation of Egypt on health inspection and monitoring of fishery products may be considered equivalent to those laid down in Directive 91/493/EEC.

(2) The requirements in the legislation of Kenya on health inspection and monitoring of fishery products may be considered equivalent to those laid down in Directive 91/493/EEC.

(2) The requirements in the legislation of Guyana on health inspection and monitoring of fishery products may be considered equivalent to those laid down in Directive 91/493/EEC.

(2) The requirements in the legislation of Romania on health inspection and monitoring of fishery products may be considered equivalent to those laid down in Directive 91/493/EEC.

(3) The requirements in the legislation of Serbia and Montenegro on health inspection and monitoring of fishery products may be considered equivalent to those laid down in Directive 91/493/EEC.

(2) The requirements in the legislation of Mayotte on health inspection and monitoring of fishery products may be considered equivalent to those laid down in Directive 91/493/EEC.

(2) The requirements in the legislation of Zimbabwe on health inspection and monitoring of fishery products may be considered equivalent to those laid down in Directive 91/493/EEC.

Therefore, it is necessary to add a specific mention of the appropriate check in the health certificate accompanying the fishery products imported from Tanzania and established in the Commission Decision 98/422/EC (3).

(2) The requirements in the legislation of Saint Pierre et Miquelon on health inspection and monitoring of fishery products may be considered equivalent to those laid down in Directive 91/493/EEC.

(3) The VD-MA has provided official assurances on compliance with the standards for health controls and monitoring of fishery and aquaculture products as set out in Directive 91/493/EEC and on the fulfilment of hygienic requirements equivalent to those laid down in that Directive.

Consignments of fishery products introduced into the territories defined in Annex I of Directive 90/675/EEC shall come from an agreed establishment inspected by the competent authority of the third country, and shall be accompanied by a numbered original health certificate attesting that the health conditions of production, handling, processing, packaging and identification of the products are at least equivalent to those established by Directive 91/493/EEC.

Following a restructuring of the Russian administration, the Commission adopted Decision 2002/808/EC of 16 October 2002 amending Decision 97/102/EC laying down special conditions governing imports of fishery and aquaculture products originating in Russia (4), to modify the name of the competent authority for issuing health certificates for fishery products and to identify the authority responsible for the inspection and approval of the establishments and vessels.

Without prejudice to Directive 90/675/EEC of 10 December 1990 laying down the principles governing the organization of veterinary checks on products entering the Community from third countries (1) and Directive 91/493/EEC of 22 July 1991 laying down the health conditions for the production and the placing on the market of fishery products (2), fishing vessels mentioned in Article 1 may not land their catches for release for free circulation and marketing except at ports designated by the Member States.

Whereas Community inspections in Madagascar have shown that there are serious deficiencies with regard to infrastructure and hygiene in meat establishments and that there are not enough guarantees of the efficiency of the controls carried out by the competent authorities; whereas animal health management in Madagascar shows severe deficiencies and non-application of Community rules; whereas there is a potential risk for public health with regard to the production and processing of animal products, excluding fishery products, in this country;

Whereas Community arrangement have been defined in respect of imports from third countries; whereas these arrangements require the drawing up of lists of third country establishments from which imports of certain products are permitted in accordance with Article 14.B (2) (a) of Council Directive 71/118/EEC of 15 February 1971 on health problems affecting the production and placing on the market of fresh poultrymeat fn, Article 4 (1) of Council Directive 72/462/EEC of 12 December 1972 on health and veterinary inspection problems upon importation of bovine, ovine and caprine animals and swine, fresh meat or meat products from third countries fn, Article 9 (3) (c) of Council Directive 91/492/EEC of 15 July 1991 laying down the health conditions for the production and placing on the market of live bivalve molluscs fn, Article 11 (4) (c) of Council Directive 91/493/EEC of 22 July 1991 laying down the health conditions for the production and placing on the market of fishery products fn, Article 16 (3) (a) of Council Directive 92/45/EEC of 16 June 1992 on public health and animal health problems relating to the killing of wild game and the placing on the market of wild game meat fn, Article 23 (3) (a) of Council Directive 92/46/EEC of 16 June 1992 laying down the health rules for the production and placing on the market of raw milk, heat-treated milk and milk-based products fn and Article 10 (3) (b) of Council Directive 92/118/EEC of 17 December 1992 laying down animal health and public health requirements governing trade in and imports into the Community of products not subject to the said requirements laid down in specific Community rules referred to in Annex A (I) to Directive 89/662/EEC, and, as regards pathogens, to Directive 90/425/EEC fn;

The provisions of Turkish legislation on health inspection and monitoring of fishery products may be considered equivalent to those laid down in Directive 91/493/EEC.

The requirements in the legislation of Egypt on health inspection and monitoring of fishery products may be considered equivalent to those laid down in Directive 91/493/EEC.

The requirements in the legislation of Kenya on health inspection and monitoring of fishery products may be considered equivalent to those laid down in Directive 91/493/EEC.

The requirements in the legislation of Guyana on health inspection and monitoring of fishery products may be considered equivalent to those laid down in Directive 91/493/EEC.

COMMISSION DECISION of 20 May 1994 laying down detailed rules for the application of Council Directive 91/493/EEC, as regards own health checks on fishery products

The requirements in the legislation of Serbia and Montenegro on health inspection and monitoring of fishery products may be considered equivalent to those laid down in Directive 91/493/EEC.

The requirements in the legislation of Mayotte on health inspection and monitoring of fishery products may be considered equivalent to those laid down in Directive 91/493/EEC.

Commission Decision 94/356/EC of 20 May 1994 laying the detailed rules for the application of Council Directive 91/493/EEC, as regards own health checks on fishery products (OJ L 156, 23.6.1994, p. 50).

The VD-MA has provided official assurances on compliance with the standards for health controls and monitoring of fishery and aquaculture products as set out in Directive 91/493/EEC and on the fulfilment of hygienic requirements equivalent to those laid down in that Directive.

Point IV of the health certificate laid down in the Annex to the Decision 98/422/EC and accompanying the consignments of fishery products from or originating in Tanzania and caught in the Lake Victoria, must be completed by the following point: "- The official inspector hereby certifies that the fishery products specified above were produced under a system of monitoring checks as laid down in chapter V, point II.3.B of the Annex to the Directive 91/493/EEC, and the results of these checks are satisfactory."

In accordance with the procedure laid down in Article 29, derogations may be granted from the provisions of Article 6(1)(b) and, as regards the staff responsible for carrying out the checks and for issuing certificates, from those of Article 4(1) and Article 5(1) for border inspection posts where fish are presented in accordance with Council Directive 91/493/EEC of 22 July 1991 laying down the health conditions for the production and the placing on the market of fishery products (21).
