the name of a geographical unit as referred to in paragraph 1 where the wine is obtained from a mixture of grapes, grape musts, new wines still in fermentation or, until 31 August 2003, wines originating in the geographical unit the name of which is to be used for the designation with a product obtained in the same specified region but outside that unit, provided that at least 85 % of the quality wine psr concerned is obtained from grapes harvested in the geographical unit the name of which it bears, and provided, in respect of the exception expiring on 31 August 2003, that such an arrangement was allowed by the provisions of the producer Member State concerned before 1 September 1995;

This temporary measure is the only option available for ensuring that the 2000 grape harvest is not spoiled and can thus be used for wines produced in Germany.

Regulation (EC) No 1622/2000 should therefore be amended to allow for an increase in the maximum total sulphur dioxide level of wines produced in Germany from the 2000 grape harvest.

All wines obtained from grapes harvested in 2000'

By letter of 21 May 2001, the German Government requested authorisation to increase the maximum permissible total sulphur dioxide content of wine, which is set at less than 300 milligrams per litre, by a maximum of 40 milligrams per litre for wine produced in Germany from the 2000 grape harvest in the wake of exceptionally unfavourable weather conditions.

(3) The Member States concerned should be permitted therefore to authorise the acidification of grape must and wine from zones A and B for the 2003 harvest under the conditions laid down in points E.2, E.3 and E.7 of Annex V to Regulation (EC) No 1493/1999.

' However, for wine years 2003/04 to 2004/05 for rectified concentrated musts obtained from grapes harvested outside wine- growing zones CIII (a) and CIII (b), in establishments that began production of rectified concentrated musts before 1 January 1986 in the case of Spain, and before 30 June 1982 elsewhere, the aid shall be that specified for zone CIII products.'

However, for wine years 2000/01, 2001/2002 and 2002/03 for rectified concentrated musts obtained from grapes harvested elsewhere than in wine-growing zones C III (a) and C III (b) and produced in establishments that began production of rectified concentrated musts before 1 January 1986 in Spain or before 30 June 1982 elsewhere, the amount shall be that laid down for products of wine-growing zones C III.

The Member States concerned should be permitted therefore to authorise the acidification of grape must and wine from zones A and B for the 2003 harvest under the conditions laid down in points E.2, E.3 and E.7 of Annex V to Regulation (EC) No 1493/1999.

In derogation from the rules laid down in Annex V, point E.1, to Regulation (EC) No 1493/1999, the Member States may authorise the acidification of grape must and wine from the 2003 harvest in wine-growing zones A and B under the conditions laid down in points E.2, E.3 and E.7 of that Annex.

In Article 13(1) the second subparagraph is replaced by:"However, for wine years 2003/04 to 2004/05 for rectified concentrated musts obtained from grapes harvested outside wine-growing zones CIII (a) and CIII (b), in establishments that began production of rectified concentrated musts before 1 January 1986 in the case of Spain, and before 30 June 1982 elsewhere, the aid shall be that specified for zone CIII products."

Article 13(2)(b) and (3)(a) of Commission Regulation (EEC) No 3201/90 of 16 October 1990 laying down detailed rules for the description and presentation of wines and grape musts(7), as last amended by Regulation (EC) No 1640/2000(8) provide for derogations from Articles 30 and 31 of Regulation (EEC) No 2392/89 for certain imported wines with regard to the possibility of using the name of a vine variety and the year of harvest.
