DETERMINED to contribute effectively to the fight against illicit trade in cultural objects by taking the important step of establishing common, minimal legal rules for the restitution and return of cultural objects between Contracting States, with the objective of improving the preservation and protection of the cultural heritage in the interest of all,

Ensure, through internal control, that the works are carried out in accordance with the previous points, and, if works are being carried out on a works protected in accordance with regulations on the protection of cultural heritage, also ensure the appropriate involvement of the relevant service for the protection of cultural heritage

In the preparation of the plan, besides regulations, programmes and plans from the spheres of environmental protection, nature conservation, the protection of natural resources, the protection of cultural heritage and environmental starting-points, the guidelines and background provided by ministries and organisations responsible, with regard to the content of the plan, for individual environmental protection matters or the protection or use of natural goods or the protection of cultural heritage, must also be taken into account.

the process of identification, study, interpretation, protection, conservation and presentation of the cultural heritage;

Noting the far-reaching impact of the activities of UNESCO in establishing normative instruments for the protection of the cultural heritage, in particular the Convention for the Protection of the World Cultural and Natural Heritage of 1972,

- existing publicly accessible data on the situation in the spheres of environmental protection, protection against natural and other disasters, nature conservation, protection and use of natural resources, protection of human health and protection of cultural heritage;

CONVINCED of the fundamental importance of the protection of cultural heritage and of cultural exchanges for promoting understanding between peoples, and the dissemination of culture for the well-being of humanity and the progress of civilisation,

b enhance the value of the cultural heritage through its identification, study, interpretation, protection, conservation and presentation;

2. In the Cultural Heritage Protection Act (Ur. l. RS, No. 7/99), in the first paragraph of Article 46 the words "or for the registration of works" shall cease to apply.

Referring to the various instruments of the Council of Europe, in particular the European Cultural Convention (1954), the Convention for the Protection of the Architectural Heritage of Europe (1985), the European Convention on the Protection of the Archaeological Heritage (1992, revised) and the European Landscape Convention (2000);

- a significant interruption of the conservation or advancement of the good state of the environment and parts thereof, defined by the environmental objectives, or the protection of areas on the basis of the requirements of environmental protection, nature conservation, the protection of natural resources, the protection of human health and the protection of cultural heritage.

6. That the intended construction does not lie in an area protected pursuant to regulations on the protection of cultural heritage or pursuant to regulations on nature conservation, or, if the intended construction lies in an area protected pursuant to regulations on the protection of cultural heritage or on nature conservation, that heritage protection or nature conservation approval has been obtained

c) a representation of the special protection areas, protected areas, degraded areas and other areas in which a special legal regime has been prescribed for the purposes of environmental protection, nature conservation, protection of natural resources or protection of cultural heritage;

c exercise of the right to cultural heritage may be subject only to those restrictions which are necessary in a democratic society for the protection of the public interest and the rights and freedoms of others.

(2) A cultural object which has been temporarily exported from the territory of the requesting State, for purposes such as exhibition, research or restoration, under a permit issued according to its law regulating its export for the purpose of protecting its cultural heritage and not returned in accordance with the terms of that permit shall be deemed to have been illegally exported.

ACKNOWLEDGING that implementation of this Convention should be accompanied by other effective measures for protecting cultural objects, such as the development and use of registers, the physical protection of archaeological sites and technical co-operation,

(1) The starting-points for the preparation of an environmental report are the environmental objectives of the plan, the evaluation criteria and the methodology for identifying and evaluating the effects of the plan on the environment, nature conservation, the protection of human health and the protection of cultural heritage.

(a) altering the status or diminishing the level of protection under the 1972 Convention concerning the Protection of the World Cultural and Natural Heritage of World Heritage properties with which an item of the intangible cultural heritage is directly associated; or

- measures envisaged for the prevention, mitigation and elimination of the consequences of any important essential or destructive effects of the plan on the environment, nature conservation, the protection of human health and the protection of cultural heritage (hereinafter:

(1) On the basis of the starting-points for the preparation of the environmental report under Article 4 of this Decree, the effect of the implementation of the plan on the environment and parts thereof, and the inclusion of the requirements of environmental protection, nature conservation and the protection of human health and cultural heritage in the plan, while taking into account mitigating measures, is assessed in two phases:

6. It failed to acquire location information prior to commencing investment maintenance works carried out on the exterior of a works that borders a public area or on a works that is protected in accordance with regulations on cultural heritage (second paragraph of Article 6)

In the past, protection efforts were focused more on natural heritage and natural monuments, in accordance with the Natural and Cultural Heritage Act62, and less on nature as a whole.

(3) Suitable criteria for evaluating the effects of the plan on the environment, nature conservation, the protection of human health and the protection of cultural heritage are degrees of deviation from environment status indicators, degrees of achievement of protection objectives and other criteria providing suitable evaluation of the effects of the plan.

Realizing the need to codify and progressively develop rules relating to the protection and preservation of underwater cultural heritage in conformity with international law and practice, including the UNESCO Convention on the Means of Prohibiting and Preventing the Illicit Import, Export and Transfer of Ownership of Cultural Property of 14 November 1970, the UNESCO Convention for the Protection of the World Cultural and Natural Heritage of 16 November 1972 and the United Nations Convention on the Law of the Sea of 10 December 1982,

(1) An environmental report is a document in which significant effects of the plan on the environment, nature conservation, the protection of human health and the protection of cultural heritage are defined, described and evaluated, along with possible alternatives, taking into account the environmental objectives and characteristics of the area to which the plan relates.

5. The permit on the basis of Articles 27, 60 and 61 of the Cultural Heritage Protection Act (Ur. l. RS, No. 7/99) in the case of the construction or execution of works by which there is an encroachment upon works protected pursuant to regulations on cultural heritage, in the case of archaeological digs and research that could damage archaeological finds, and in the case of research that entails encroachment upon heritage or a monument, and the cultural protection conditions and approval on the basis of Articles 45, 46 and 47 of the aforementioned act of law for constructions that could affect the regime of protection, preservation and maintenance of heritage real estate 6. Without prejudice to national provisions safeguarding the artistic and cultural heritage of Contracting States, goods imported or exported by the Institute and strictly necessary for the exercise of its official activities shall be exempt from any turnover tax, customs duties and other taxes or charges, and from all prohibitions and restrictions on import or export.

A state body or the manager of a works of national public infraworks or a works or area protected pursuant to regulations on the protection of cultural heritage or nature conservation acts as the approving authority and issues an invoice for the payment of material costs for the definition of project conditions (second paragraph of Article 51).

environmental objectives are the assumed obligations set out in ratified international treaties or EU regulations relating above all to transboundary environmental impacts and global pollution, and protection objectives in areas with a special legal regime, including guidelines, starting-points, restrictions and prohibitions for the purpose of environmental protection, nature conservation, protection of natural resources or protection of cultural heritage.

Having regard to the legal texts existing at international level in the field of protection and management of the natural and cultural heritage, regional and spatial planning, local self government and transfrontier co-operation, in particular the Convention on the Conservation of European Wildlife and Natural Habitats (Bern, 19 September 1979), the Convention for the Protection of the Architectural Heritage of Europe (Granada, 3 October 1985), the European Convention on the Protection of the Archaeological Heritage (revised) (Valletta, 16 January 1992), the European Outline Convention on Transfrontier Co-operation between Territorial Communities or Authorities (Madrid, 21 May 1980) and its additional protocols, the European Charter of Local Self-government (Strasbourg, 15 October 1985), the Convention on Biological Diversity (Rio, 5 June 1992), the Convention concerning the Protection of the World Cultural and Natural Heritage (Paris, 16 November 1972), and the Convention on Access to Information, Public Participation in Decision-making and Access to Justice on Environmental Matters (Aarhus, 25 June 1998);

- that all those elements of the plan which could by themselves or through cumulative or synergistic effects with other plans or activities have an important effect on the environment have been duly considered using appropriate methods from the point of view of all environmental impacts and with regard to all foreseeable consequences of the plan on the environment, natural resources, nature conservation and the protection of human health and cultural heritage;

Aid may be granted up to 60 %, or 75 % in less favoured areas, of the real costs incurred as regards investments or capital works intended for the conservation of heritage features of productive assets on farms, such as farm buildings, provided that the investment does not entail any increase in the production capacity of the farm.

the cultural aspects of the European Union, and in particular improving the knowledge and dissemination of culture, the conservation and safeguarding of cultural heritage, cultural exchanges and artistic creation (Article 151 of the EC Treaty);

preparatory studies and technical assistance for the preservation of the cultural heritage.

Whereas Regulation (EEC) No 3911/92 introduces, together with this Directive, a Community system to protect Member States' cultural goods;

Whereas, in view of the completion of the internal market, rules on trade with third countries are needed for the protection of cultural goods;

Whereas this value 0 (zero) means that goods belonging to the categories in question, whatever their value - even if it is negligible or zero - are to be considered 'cultural objects' within the meaning of the Directive, certain authorities have interpreted it in such a way that the cultural object in question has no value at all, thereby depriving those categories of goods of the protection afforded by the Directive.

A mechanism should make it possible to mobilise, and facilitate coordination of, assistance interventions in order to help ensure better protection primarily of people but also of the environment and property, including cultural heritage, thereby reducing loss of human life, injury, material damage, economic and environmental damage, and making achievement of the objectives of social cohesion and solidarity more tangible.
