Definicija: This is a general concept which has no legal definition in the EU Member States. "Group" is interpreted broadly and can refer to persons of a particular religious belief, social (e.g. homosexuals), and/or coming from a particular region within a country. In any case, whilst a group may be persecuted, asylum applications are addressed on an individual basis in the Member States, and not all together as one group. The concept given here is taken from that developed in rulings of Germany’s highest administrative court.

Definicija: Actors of persecution or serious harm include: (a) the State; (b) parties or organisations controlling the State or a substantial part of the territory of the State; (c) non-State actors, if it can be demonstrated that the actors mentioned in (a) and (b), including international organisations, are unable or unwilling to provide protection against persecution or serious harm as defined in Article 7 of Council Directive 2004/83/EC.
