Definicija: Community law is either directly applicable in the Member States (in the case of regulations) or transposed into national legislation (in the case of directives) (1). It follows from the New Approach directives that presumption of conformity (q.v.) is also dependent on the transposition of the European standard into a national standard. This means that no presumption exists unless the European standard has been transposed, even if the reference has been published in the OJEC. On the other hand, it is not necessary for transposition to take place in all Member States before benefit accrues from the presumption of conformity (2).
